DMCA & Trademark Compliance Policy – Golden
Introduction
Golden does not host external content such as promotional material or product pages (“Client Material”) on its domain goldenbusiness.llc. Instead, content is typically hosted by third-party sellers or affiliates, over whom Golden has no authority or control. Therefore, Golden is only able to disable access to payment pages it hosts, and cannot remove Client Material published on external websites. If you wish to request removal of Client Material itself, please contact the hosting website or its owner directly.
Golden is committed to respecting intellectual property rights and expects all users and partners to do the same. Although Golden does not host the disputed content itself, we comply with the Digital Millennium Copyright Act (DMCA) for handling reported infringements involving content that links to Golden’s payment pages. Upon receiving a valid complaint, we may disable access to such links in accordance with the DMCA.
How to Submit a Takedown Request
If you believe your copyrighted material is being misused or unlawfully linked to Golden’s payment platform, you may submit a DMCA Takedown Notice to our Copyright Agent.
Your notice must include:
- The subject line “TAKEDOWN NOTICE”;
- A detailed description of the copyrighted work being infringed;
- A clear identification of the content or page linking to Golden’s payment system and sufficient information for us to locate it;
- The following statement:
“I declare, under penalty of perjury, that the information in this notice is accurate and that I am the copyright owner or legally authorized to act on behalf of the owner, and that I have a good faith belief that the disputed use is not authorized by law, the owner, or their agent.”
- Your legal name, business name (if applicable), contact information (including email);
- Your physical or electronic signature;
- The current date.
Please send the complete Takedown Notice to:
Golden Business Llc.
1942 Broadway St Ste 314C
Boulder, CO 80302 – USA
📧 Email: support@goldenbusiness.llc
Golden will act upon valid notices by disabling access to the specified payment link and will notify the associated account holder.
⚠️ Submitting false or misleading takedown requests may carry legal consequences. Consider legal advice before proceeding.
Submitting a Counter-Notice
If you are a Golden client and believe that a takedown was made in error, you may submit a Counter-Notice to request the restoration of access.
The Counter-Notice must include:
- A description of the affected content and where it was located;
- A statement affirming your good faith belief that removal was a mistake or misidentification;
- Your full name, address, phone number, and email;
- A declaration that you consent to jurisdiction in the federal courts of Colorado and accept service of process from the complainant;
- Your signature (physical or digital).
After receiving your Counter-Notice, Golden will forward it to the original complainant. Unless legal action is initiated within 10 to 14 business days, Golden may restore access to the payment page.
Repeat Infringement Policy
Clients who are subject to multiple takedown requests that are not properly rebutted may have their accounts suspended or terminated. Golden reserves the right to take appropriate action without liability or warning.
Golden’s Right to Disable Access
Golden retains the discretion to independently disable access to any payment page if, in our sole judgment, the associated content infringes upon intellectual property or violates applicable laws, even without receiving a formal complaint.
To learn more about DMCA regulations, visit: www.copyright.gov
Trademark Complaints
If Golden receives a written claim (such as a Cease & Desist letter) stating that a Client’s content infringes or misuses a third-party trademark, we may:
- Contact the Client to notify them of the issue, and/or
- Disable access to payment pages linked from the disputed content.
Golden may reinstate access to the affected page if:
- We receive written confirmation from the complaining party that the issue is resolved, or
- The Client submits a satisfactory rebuttal, including:
- A counter-response with details similar to those required in the DMCA process, but related to the trademark dispute; and
- A signed statement agreeing to indemnify Golden for any damages or costs that result from restoring the disputed link.
- A counter-response with details similar to those required in the DMCA process, but related to the trademark dispute; and
Client Agreement and Waiver
By registering and using Golden’s services, you agree that:
- Golden is not obligated to restore access even if a rebuttal is submitted;
- You waive any claims against Golden for revenue loss, reputation damage, or costs related to link removal;
- DMCA-specific protections apply solely to copyright—not to trademark, patent, or other IP disputes.
This policy is an extension of your agreement with Golden and forms part of your Client Contract.
Final Note
If at any point you disagree with the terms of this policy, your remedy is to discontinue use of Golden’s platform. However, any transactions or links active before your departure remain governed by this policy and your Client Agreement.
